Overview

Personal Data generally means data that identifies or is reasonably likely to identify an individual, directly or indirectly, as well as data that relates to, describes, is reasonably likely to be associated with or could reasonably be linked to an identified or reasonably identifiable individual. For the purposes of this Privacy Policy, only the definition of personal data in the law in force in your country of legal residence will apply to you and will be considered as your "Personal Data".

A. Personal data we collect from you

We may collect the following categories of Personal Data directly from you:

• Identification data, such as name, e-mail address, telephone number, postal address and other elements that we provide to you according to the needs related to your use (use and connection on the platform, customer service, printing, delivery);
• Audio and visual data, such as images collected to enrich your book;

B. Personal data we collect automatically

We may automatically collect the following categories of Personal Data through your use of our services:

• Online identifiers, such as IP address, domain name ;
• Device data, such as hardware, operating system, browser, screen size; and
• Usage data, such as system activity, internal and external information related to the TaLegacy pages you visit, click stream information

Our automatic collection of Personal Data may involve the use of Cookies, described in more detail below.

C. Business and commercial purposes for which we collect and use your Personal Data

The Personal Data we collect and the practices described above are intended to provide you with the best possible experience, to protect you against the risks associated with inappropriate use and fraud, and to help us maintain and improve TaLegacy. We may use your Personal Data to:

• To provide you with our Services. We use your Personal Information to provide you with our Services in accordance with our TOU.  
• To comply with legal and regulatory requirements. We process your Personal Data in accordance with applicable laws and regulations. 
• Protect the security and integrity of our services. We use your Personal Data to reinforce our security-oriented approach.
• Provide you with customer service. We process your Personal Data whenever you contact our Customer Service Team, for example in the event of problems with your account. 
• Optimize and improve our services. We use your Personal Data to understand how our products and services are used. This enables us to improve our services and develop new products. 
• To market our products to you. We may contact you with information about our products and services that may be of interest to you. You may use the tools provided to unsubscribe from our marketing communications at any time.
• With your consent. We may use your Personal Information for other purposes with your consent.
• Other business purposes. We may use your Personal Data for other purposes within the scope of our business operations, which would be reasonably expected based on the context, and as permitted or required by law to meet our legal obligations.

D. How we share your Personal Information

We will not share your Personal Data with third parties, except as described below:

1. Service providers. We may share your Personal Information with third-party service providers for business or commercial purposes. Your Personal Data may be shared so that they can provide services to us, including identity verification, security threat detection, payment processing, customer service, data analysis, information technology, advertising, marketing, data processing, network infrastructure, storage and transaction tracking. We share your Personal Data with these service providers only so that they can provide services to us, and we prohibit our service providers from using or disclosing your Personal Data for any other purpose. Our third-party service providers are subject to strict confidentiality obligations.
2. Business partners. We may share your Personal Information with other companies with whom we have a partnership to provide you with services or other offerings and to conduct other related activities.
3. Analysis partners. We may share your Personal Information with partners who help us analyze and measure the effectiveness of our content, services, marketing and advertising efforts.
4. Marketing and advertising partners. We may share your Personal Data with third parties for marketing and advertising purposes, including on third-party social networks and advertising networks and with other parties who help us deliver and optimize our advertisements.
5. Legal obligations. We may be required or believe in good faith and in our sole discretion that it is necessary to share your Personal Data with law enforcement, government agencies, regulators or third parties in order to comply with legal or regulatory requirements, to preserve our rights or to protect against other unlawful activity.
6. Corporate Transactions. We may disclose Personal Data in the event of a proposed or completed merger, acquisition, reorganization, asset sale or similar corporate transaction, or in the event of bankruptcy or dissolution.
7. Professional advisors. We may share your Personal Data with our professional advisors, including legal, accounting or other consulting services, for auditing purposes or to meet our legal obligations.
8. Consent. We may share or disclose your Personal Information with your consent.
9. We may share or disclose your Personal Information for other business orcommercial purposes as permitted by law.

If we decide to change the purposes for which your Personal Information is collected, used or shared, or our practices with respect to your Personal Information, we will modify this Privacy Policy as described below.

4. Cookies

When you access TaLegacy, we may use the standard practice of placing tiny data files called cookies, flash cookies, web beacons or other tracking tools ("Cookies") on your computer or other devices used to visit TaLegacy. We use Cookies to recognize you as a customer, to collect information about your use of TaLegacy in order to better customize the services and content we offer, and to collect information about your computer or other access devices in order to: (i) ensure that the security of your account has not been compromised by detecting irregular, suspicious activity on your account; (ii) evaluate and improve our services and advertising campaigns.

We may use third-party cookies or analysis services.

We do not control third-party tracking technologies, and statements about our practices do not apply to such third parties or their use of information. We make no representations regarding the policies or practices of such third parties. We are not responsible for the effectiveness of or compliance with third-party opt-outs.

5. Direct marketing

Subject to applicable laws and regulations, we may from time to time send you direct marketing communications to promote services, products, facilities or activities using information collected from or about you. You may unsubscribe from these marketing communications at any time by emailing marketing[at]talegacyremembered.com. You may also unsubscribe from these communications by following the instructions provided in these marketing communications. If you choose not to receive marketing communications, please note that we may still send you necessary information regarding transactions or our business relationship. Our policy does not allow us to provide your Personal Data to third parties for direct marketing purposes without your consent.

6. Personal data concerning children

TaLegacy is not directed at children under the age of 16 and we do not knowingly collect Personal Information from children under the age of 16. If we discover that we have collected Personal Data from a child under the age of 16, we will promptly delete it from our systems.

7. Information security

We take reasonable steps, including administrative, technical and physical safeguards, to protect your Personal Data against loss, theft or misuse, as well as unauthorized access, disclosure, alteration or destruction. However, no security is infallible, and the Internet is not a secure medium. We cannot guarantee absolute security, but we make every effort to protect TaLegacy and you against unauthorized access to or unauthorized alteration, disclosure or destruction of the Personal Data we collect and store. Measures we take may include encrypting TaLegacy website communications using SSL; periodically auditing our Personal Data collection, storage and processing practices; and restricting access to your Personal Data on a need-to-know basis for our employees, subcontractors and agents who are subject to strict contractual confidentiality obligations and may be subject to disciplinary action or dismissal for failure to comply with these obligations.

8. Conservation

We retain your Personal Data for as long as is reasonably necessary to provide services to you, for legitimate business purposes and to meet our legal and regulatory obligations. If you terminate your account with us, we will continue to retain your Personal Data to the extent necessary to meet our legal and regulatory obligations, including for the monitoring, detection and prevention of fraud, as well as for our tax, accounting and financial reporting obligations.

9. International transfers

TaLegacy is a global company based in France, with servers at OVH. Data is therefore stored in France. Data from each country may be processed in its own country as well as in France. These other countries may have privacy or data protection rules that differ from those in your country. However, we will take steps to ensure that such transfers comply with applicable data protection laws and that your Personal Data is protected in accordance with the standards described in this Privacy Policy. In certain circumstances, the courts, law enforcement agencies, regulatory bodies or security authorities of these other countries may be authorized to access your Personal Data.

Your rights

• Right to know. You may ask TaLegacy to disclose the categories of Personal Data we have collected about you, the categories of sources from which your Personal Data is collected, the business or commercial purpose for collecting, selling or sharing your Personal Data, the categories of third parties from whom we disclose your Personal Data, and the specific elements of the Personal Data we have collected about you.
• Right to erasure. You may request TaLegacy to delete Personal Data about you that we have collected from you. Please note that there are certain reasons why we will not be able to fully comply with your request, for example if we need to complete a transaction for you, to detect and protect against fraudulent and illegal activity, to exercise our rights, for our internal purposes or to comply with a legal obligation.
• Right of rectification. You may ask TaLegacy to rectify inaccurate Personal Data that we may hold about you, subject to appropriate verification.

How to submit a request

You may request access to, deletion of, or correction of your Personal Data by following the link to exercise your privacy rights on your Account Profile page or by e-mailing us at privacy[a]talegacyremembered.com. We are legally required to verify your identity when you make a request. We may ask you for additional information, such as your date of birth or a personal identification number, to verify your identity. TaLegacy will confirm receipt of your request within 10 business days and respond within 45 calendar days, after completing the necessary verifications, unless we require additional time, in which case we will let you know. If we are unable to verify your identity, we may refuse your request. Requests for deletion of Personal Data must also be confirmed by e-mail.

Agent requests

You may appoint an agent to make a request on your behalf regarding your privacy rights.agents will need to demonstrate that they are authorized to act on your behalf or have power of attorney in accordance with applicable legal provisions. TaLegacy reserves the right to ask you directly for confirmation that the agent is authorized to make such a request or to request additional information to verify the agent's identity.Authorized agents are not permitted to use a consumer's Personal Data or any other information collected from or about the consumer for any purpose other than responding to requests or conducting verifications.

Unsubscribe requests

You may refuse the "sale" or "sharing" of your Personal Data at any time by sending us an e-mail at privacy[a]talegacyremembered.com. 

Data protection disclosures

Categories of personal data disclosed for commercial purposes

With respect to the above requests, over the past 12 months, we have disclosed the following categories of Personal Data for business purposes to support the purposes for which TaLegacy uses the Personal Data described above (for example, with our service providers who may not use your Personal Data outside the scope of the services they provide to us):

• Identifiers disclosed to our service providers
• Business information disclosed to our service providers
• Information about activity on the Internet or other electronic networks communicated to our service providers
• Sensory data, including audio, visual or similar information, communicated to our service providers.

Use and Disclosure of Sensitive Personal Information. To the extent that we collect, use or share "sensitive personal data", we limit the use or disclosure of such sensitive personal data to authorized business purposes.

11. Updates to this Privacy Policy 

We may modify this Privacy Policy from time to time to reflect changes in our data privacy practices, improve the user experience or comply with applicable laws. The heading "Last Updated" at the top of this Privacy Policy indicates the date on which this Privacy Policy was last revised. Any changes are effective when we post the revised Privacy Policy. Your continued use of TaLegacy following the posting of changes to this Privacy Policy indicates your understanding and acceptance of those changes.
